What California Is Prosecuting This Man For Will Make Your Blood Boil!

Not that any of us have believed California to be the ‘Capital of Justice’ but their latest dig into American Rights will leave you seeing red.

Apparently, in the ultra-blue state, your freedom of speech can be considered a crime, or at least online? While the man in this article may have been targetting a particular page on Facebook to have official get involved, much less seek prosecution, is outrageous.

We are a fairly small site, ourselves, and receive more than our share of liberal numbskulls (Yes we see you but you’re not worth our time.) ranting and rambling on our page as well as on our Facebook and we ignore them. At the very least we believe the page in this article could have simply blocked the guy and moved on with life. This just seems a little too far, to me. Take a look.

Here in the United States of America, the California Attorney General is actually prosecuting a man for Internet insults.ย Eugene Volokh:

In September 2016, Mark Feigin posted five insulting comments on the Islamic Center of Southern Californiaโ€™s Facebook page (before he was finally blocked by the ICSC from commenting):

  • โ€œTHE TERROR HIKE โ€ฆ SOUNDS LIKE FUNโ€ (written in response to the Centerโ€™s โ€œSunset Hikeโ€ announcement).
  • โ€œTHE MORE MUSLIMS WE ALLOW INTO AMERICA THE MORE TERROR WE WILL SEE.โ€
  • โ€œPRACTICING ISLAM CAN SLOW OR EVEN REVERSE THE PROCESS OF HUMAN EVOLUTION.โ€
  • โ€œIslam is dangerous โ€“ fact: the more muslim savages we allow into america โ€“ the more terror we will see -this is a fact which is undeniable.โ€
  • โ€œFilthy muslim s**t has no place in western civilization.โ€ [Note by Patterico: I bleeped the expletive here, but Feiginโ€™s original comment contained the curse word.]

California is now prosecuting him for posting these comments, on the theory that they violate Cal. Penal Code ยง 653m(b):

Every person who, with intent to annoy or harass, makes repeated telephone calls or makes repeated contact by means of an electronic communication device โ€ฆ to another person is โ€ฆ guilty of a misdemeanor. Nothing in this subdivision shall apply to telephone calls or electronic contacts made in good faith or during the ordinary course and scope of business.

These are Facebook comments, not calls into a personโ€™s home. All the organization had to do was block the guy. But they, and the Attorney General, want to punish him forย what he said. And they are using the criminal justice system to do it.

As Volokh explains, the California Attorney General makes no bones about the fact that it is going after Feigin because of the content of his speech…
